Definitions
The following terms have the meanings set out beside them wherever they appear in these Terms:
"Listing" means the real estate content (including text, images, and data) created and submitted by a User to the platform for the purpose of offering a property for sale or rent during a paid publication period, and in no case represents the position, endorsement, or warranty of Mayadeen.
"Platform" means the Mayadeen application and its electronic services.
"User" means any person who accesses or uses the Platform.
1. Agreement to Terms
By accessing or using the Mayadeen mobile application or any of our services ("App" or "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App or Services.
2. Description of Service
Mayadeen is a real estate platform that allows users to:
- Post listings for sale or rent
- Browse and search for listings
- Contact property owners and agents
- Manage listings
2.1 Service Availability
Mayadeen aims to keep the Platform available on a continuous basis but does not guarantee uninterrupted availability. The Platform may be temporarily unavailable due to scheduled maintenance, emergency technical issues, or events beyond Mayadeen's reasonable control as described in Section 16.7.
Scheduled maintenance and platform-wide technical interruptions — where the Platform is unavailable to all users simultaneously — do not constitute an admin-initiated unpublishment within the meaning of Section 4.3 and do not trigger the counter-pause mechanism. The counter-pause mechanism applies exclusively to moderation actions targeting an individual listing. Mayadeen's liability for any service downtime is limited as set out in Section 10.
2.2 Platform Changes and Discontinuation
Mayadeen reserves the right to modify, suspend, or permanently discontinue any feature or the entire Platform at any time. In the event of permanent discontinuation of the Platform, Mayadeen will endeavor to provide at least 30 days' advance notice to registered users via in-app notification or email. For users with active paid listings at the time of permanent discontinuation, Mayadeen's liability is limited to the amount paid for the remaining unused portion of any active listing period, subject to the general liability cap in Section 10.1. Feature modifications and non-material changes to the Platform do not entitle users to any refund or compensation.
3. User Accounts
3.1 Registration
To post listings, you must create an account by providing accurate and complete information. You are responsible for maintaining the security of your account credentials.
3.2 Account Responsibilities
- You must be at least 18 years old to create an account
- You are responsible for all activities under your account
- You must notify us immediately of any unauthorized use
- One person or entity may maintain only one account
3.3 Data Responsibility and Deemed Receipt of Notices
The user bears full responsibility for the accuracy of the email address used to create the account. The user must ensure the accuracy and updating of their contact information, as all notifications sent to the registered email address are considered received 24 hours after sending, whether or not the user has read or accessed them.
In addition, the platform delivers certain notices through in-app notifications posted within the Mayadeen application. Any in-app notification is deemed received 24 hours after it is posted within the application, whether or not the user has opened, viewed, or acknowledged it. The user is responsible for maintaining access to the application and for regularly checking in-app notifications. The platform is not obligated to deliver the same notice by any additional channel unless expressly stated otherwise in these Terms.
3.4 User Responsibility When Reporting
When submitting a report about a listing or content, you confirm that:
- The report is submitted in good faith and not for malicious or competitive purposes
- The information provided in the report is accurate and truthful to the best of your knowledge
- You have an objective basis to believe the listing violates these Terms
Warning: Submitting false or malicious reports may result in suspension or termination of your account.
3.5 Professional and Commercial Users (Agents and Brokers)
If you are a real estate agent, broker, or any other property professional using the Platform in a commercial capacity, you additionally represent and warrant that:
- You hold all required licenses, registrations, and authorizations required by applicable law to act as a real estate intermediary in the country where the advertised property is located
- Each listing you post is for a property that you are lawfully authorized to market on behalf of the property owner
- You will clearly disclose your professional status and agency relationship to any user who contacts you through the Platform
- You will comply with all applicable professional conduct standards and advertising regulations in the relevant country
Mayadeen does not verify professional licensing. The representations above are your sole responsibility. Mayadeen reserves the right to request evidence of professional licensing at any time and to remove listings or suspend accounts where unauthorized commercial activity is found.
4. Listings
4.1 Listing Requirements
Listings must:
- Contain accurate and truthful information
- Include genuine photographs of the property
- Specify correct location and pricing
- Comply with all applicable laws and regulations in the country where the property is located
4.1.1 Authority to Advertise
By posting a listing, you represent and warrant that:
- You are the legal owner of the property, or you have been expressly authorized by the legal owner to advertise it
- You have the legal right to offer the property for sale or rent on the terms stated in the listing
- Posting the listing does not violate any court order, contractual obligation, or applicable law to which you or the property is subject
Mayadeen does not verify ownership or authorization. These representations are your sole responsibility. If Mayadeen determines that a listing was posted without authorization or contains false representations, Mayadeen reserves the right, at its sole discretion, to remove the listing, apply any moderation action under Section 11, suspend or permanently delete the account and all its associated content under Section 12, and refer the matter to competent authorities where Mayadeen deems it appropriate.
4.2 Prohibited Listing Content
The following are absolutely prohibited in listings. Violation may result in immediate removal of the listing, suspension, or permanent deletion of your account and all associated content:
- Properties that do not exist or cannot be delivered as described (phantom listings)
- Properties already sold or rented and no longer available
- Listings posted by someone who does not own the property and has no authority to advertise it
- Prices that are not the genuine asking price (bait pricing)
- Images that do not depict the advertised property
- Images taken from other listings, websites, or sources without authorization
- Images containing watermarks, phone numbers, or any contact information
- Images that are inappropriate, offensive, sexually explicit, or that violate applicable law or public morals, including content prohibited under the laws of the country where the property is located
- Properties listed in a different area, city, or country than stated
- Duplicate listings of the same property by the same user
- Commercial advertising, promotions, or offers unrelated to a specific real estate property
- Personal services, job offers, vehicles, or any non-real-estate items
- Listings that promote or facilitate illegal activities
- False or misleading information of any kind
4.3 Listing Duration
Listings are active for the duration of your selected listing period (e.g., 30, 60, 90 days...). Upon expiration, listings will be permanently deleted from the platform along with all associated content (photos, descriptions, and details). Deleted listings cannot be restored or recovered. The active listing period is calculated based on days during which the listing is publicly visible on the platform. Days during which a listing is unpublished by Mayadeen administrative action, other than as a consequence of a confirmed Terms of Service violation, are not counted against the paid listing period and are restored to the advertiser in accordance with Section 11.5.
5. Payments and Listing Fees
5.1 Pricing
Listing fees are displayed in the App or Services and are charged per listing based on the listing duration you select. Each listing has its own duration and fee:
- Listing duration (e.g., 30, 60, 90 days...)
5.2 Listing Extensions
You may extend your listing before expiration by purchasing an additional listing period. Each extension is treated as a new listing fee and is non-refundable. If a refund is granted by the app store for an extension purchase, the extended days will be removed from your listing's expiration date. If the resulting expiration date has already passed, your listing will be automatically deleted. See Section 5.5.
5.3 Payment Processing
All payments are processed through Apple App Store or Google Play Store. By making a purchase, you agree to their respective terms and conditions. Once payment is confirmed, your listing is published immediately.
5.4 Refund Policy
General Policy:
Listing fees and extension fees are non-refundable once your listing is published and active on the platform.
Refund Exceptions:
You may be entitled to a refund only if:
- Technical failure on our part prevents your listing from being published
- We fail to provide the service as described in these Terms
- Required by applicable app store policies or consumer protection laws
Refund Process:
- All refund requests are processed through Apple App Store or Google Play Store according to their refund policies
- For service-related issues, contact support@mayadeen.app
- Mayadeen does not process refunds directly
- We will cooperate with app store refund processes in accordance with our obligations under the applicable store developer agreements
5.5 Consequences of Store-Granted Refund
The listing fee constitutes the consideration for the listing service. If a refund is granted for any reason — including by unilateral Apple App Store or Google Play Store decision, whether or not Mayadeen initiated or approved the refund — the consideration for the listing service is extinguished and the associated listing will be permanently deleted effective from the date the refund is processed. Deleted listings cannot be restored.
Scope: This clause applies regardless of the grounds cited to the store when requesting the refund, including claims of technical problems, unauthorized purchase, or any other reason.
Unjust Enrichment: Obtaining a store refund while retaining the benefit of a live, active listing constitutes unjust enrichment and a material breach of these Terms. Mayadeen reserves the right to pursue recovery of the listing fee value and to suspend the account of any user who engages in this conduct.
5.6 Changes to Listing Fees
Mayadeen reserves the right to change listing fees and extension fees at any time without prior notice. Fee changes apply to new purchases and new extensions only. Listings already purchased and active at the time of the change are not affected. The fee applicable to any purchase is the fee displayed in the App at the time of that transaction.
6. User Conduct
The following are absolutely prohibited. Violation may result in immediate suspension or permanent deletion of your account and all associated content:
- Creating accounts using false identity information
- Creating multiple accounts to circumvent a suspension, ban, or any restriction imposed by Mayadeen
- Harassing, threatening, or abusing other users or Mayadeen staff
- Using the Platform to conduct or facilitate fraud, scams, money laundering, or any financial crime
- Submitting false or malicious reports against other users' listings for competitive or personal reasons
- Using automated tools, bots, or scripts to access, scrape, crawl, or interact with the Platform
- Systematically collecting listing data, pricing information, or user contact data for any commercial purpose
- Attempting to reverse-engineer, decompile, or tamper with the Platform's technology or infrastructure
- Sharing, selling, or transferring your account to another person
- Impersonating other users, real estate agents, or any other person or entity
- Using the Platform in any way that violates applicable laws or regulations
7. Intellectual Property
The App, including its design, features, and content (excluding user-generated content), is owned by Mayadeen and protected by copyright and other intellectual property laws.
7.1 Your Content
By posting listings or submitting any content to the Platform (including text, photographs, and other materials, collectively "Your Content"), you grant Mayadeen and its infrastructure and service providers a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify (including creating compressed, resized, or reformatted versions), distribute, store, cache, display, and transmit Your Content for the purposes of: (a) operating and providing the Platform and its features; (b) storing and backing up Your Content on our infrastructure; (c) displaying Your Content to other users of the Platform; and (d) promoting the Platform using examples of listed content, such as screenshots used in app store listings or promotional materials, provided that no personally identifying information of users will be included without separate consent.
This license terminates when your listing expires or is deleted, or when you delete your account, except that content retained in encrypted backups will remain subject to this license until those backups are naturally replaced during routine rotation (up to 90 days).
You represent and warrant that you own or have all necessary rights to grant this license, and that Your Content does not infringe any third-party intellectual property rights.
7.2 Map Services
Our map services and infrastructure are provided exclusively for use through the Mayadeen application.
Prohibited Activities:
- Accessing our map services outside the Mayadeen app
- Scraping, downloading, or mirroring map data from our infrastructure
- Reverse engineering our map infrastructure
- Using our services to create derivative map applications
- Automated bulk downloading from our servers
7.3 Copyright Infringement Reports (Notice and Takedown)
If you believe that content published on the Platform infringes your copyright, you may submit a written notice to support@mayadeen.app with the subject line "Copyright Infringement Notice." Your notice must include:
- Identification of the copyrighted work claimed to be infringed
- Identification of the infringing content and its location on the Platform sufficient to allow us to find it
- Your contact information (name, address, email, telephone)
- A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
- A statement, under penalty of applicable law, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf
Upon receipt of a notice, Mayadeen will review the claim and determine at its sole discretion whether it is valid. If Mayadeen finds the claim valid, it will take action using its existing moderation tools, which may include unpublishing the listing or removing the specific infringing images. If Mayadeen does not find sufficient grounds to act, the notice will be declined. Mayadeen is not obligated to act on notices that are incomplete, unsubstantiated, or submitted in bad faith.
Repeat Violations: Users who repeatedly violate these Terms — including but not limited to repeated copyright infringement — are subject to permanent account deletion, which includes the permanent deletion of all their listings and associated content, in accordance with Section 12. Deleted accounts and listings cannot be restored.
7.4 Feedback and Suggestions
If you submit feedback, suggestions, ideas, feature requests, bug reports, or any other input to Mayadeen ("Feedback"), whether through the app, by email, through the reporting system, or by any other channel, such Feedback is entirely voluntary. Mayadeen may use, implement, modify, and incorporate such Feedback for any purpose without any compensation, acknowledgment, or obligation to you.
8. Privacy
Your use of the App or Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.
8.1 Third-Party Services and Links
The Platform may contain links to, or integrate with, third-party websites, applications, or services (including map providers, phone dialers, and messaging applications). Mayadeen does not control these third-party services and is not responsible for their content, privacy practices, security, or availability. Such links and integrations do not constitute an endorsement by Mayadeen. Your use of any third-party service is governed solely by that service's own terms and policies, and Mayadeen bears no liability in connection with your use of those services.
9. Disclaimers
This application operates as an electronic platform (technical intermediary) for displaying real estate advertisements only, and does not own the advertisements or the listed properties, does not manage, inspect, or guarantee the accuracy of information or the condition of properties. All information, data, and images contained in the advertisements are posted by users (advertisers) at their full personal responsibility.
Accordingly, the user acknowledges the following:
- The application is not responsible for the accuracy of data, property ownership, or the existence of any legal disputes
- The application does not guarantee that the property is free from technical or legal defects
- The application does not participate in negotiation, sale, or collection of funds
- The application does not act as a real estate agent or broker
- The application does not assume responsibility for transactions between users
Mayadeen is a listing platform only and does not verify the accuracy of published information. Users bear full responsibility for verifying the authenticity of advertised properties.
Before completing any transaction or making any payment, you must:
- Inspect the property: Visit the property in person and verify its condition matches the description
- Official ownership verification: Verify legal ownership through the appropriate government real estate registry or land records office to confirm:
- Legal ownership and authorization to sell or lease
- Absence of liens, encumbrances, or legal disputes
- Accuracy of property details and boundaries
- Legal consultation: Consult a real estate attorney before signing any contract or agreement
- No advance payments: Do not make any payments (deposit, down payment, advance rent) before completing all legal verifications
Fraud Warning: Beware of suspicious offers, abnormally low prices, or sellers requesting advance payments before property inspection. Always verify official identification and property ownership before any payment.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP OR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO: (A) IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE; (B) WARRANTIES AS TO THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT ON THE PLATFORM, INCLUDING LISTING CONTENT POSTED BY OTHER USERS; (C) WARRANTIES THAT ACCESS TO THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; (D) WARRANTIES THAT ANY DEFECTS IN THE PLATFORM WILL BE CORRECTED; AND (E) WARRANTIES OF NON-INFRINGEMENT. NO ADVICE OR INFORMATION OBTAINED FROM MAYADEEN OR THROUGH THE PLATFORM WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
10. Limitation of Liability
10.1 Financial Liability Cap
To the maximum extent permitted by law, Mayadeen's total financial liability to any user for any claim arising from use of the App or Services is limited to the lesser of:
- The total fees paid by the user in the 12 months preceding the claim, or
- $100 USD (or equivalent in Syrian Pounds)
10.2 Exceptions to Liability Cap
The above limitation does not apply to:
- Personal injury or death caused by Mayadeen's negligence
- Fraud or fraudulent misrepresentation
- Any liability that cannot be excluded or limited under applicable law
10.3 Disclaimer for Moderation Actions
In addition to the above, Mayadeen shall not be liable for:
a. Listing or Account Suspension:
- Lost business opportunities or potential income due to temporary suspension
- Reputational damage resulting from suspension during review period
- Inability to access account during investigation
b. Listing Deletion or Removal:
- Loss of content, images, or data after removal
- Financial losses from listing removal before paid period expires
- Loss of potential customers or deals due to listing unavailability
c. Technical Failures:
- Service interruptions or performance slowdowns
- Data loss due to server or cloud storage errors
- Software bugs affecting listing visibility
- Backup or data recovery failures
d. Third-Party Actions:
- Malicious or false reports from other users
- Cyber attacks or hacking attempts
- Competitors abusing the reporting system
e. Good Faith Review Errors:
- Moderation decisions made in good faith even if later proven inaccurate
- Differences in interpretation of Terms or content standards
- Delayed responses to appeals during high-volume periods
f. Indirect or Consequential Damages:
- Loss of profits or data
- Business reputation damage
- Disputes between users
- Issues arising from third-party services (payment processors, etc.)
g. Force Majeure:
- Natural disasters, wars, or strikes
- Power or internet outages beyond our control
- Changes in laws or regulations
- Government orders or directives
10.4 User Indemnification
By using the Mayadeen App or Services, you agree to defend, indemnify, and hold harmless Mayadeen, its affiliates, subsidiaries, officers, directors, employees, agents, partners, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including but not limited to reasonable attorneys' fees and court costs) arising from or related to:
a. Your Use of the App or Services:
- Any misuse or unauthorized use of the App or Services
- Your failure to comply with these Terms of Service
- Your violation of any applicable laws or regulations
b. Your Listings and Content:
- False, misleading, inaccurate, or fraudulent information in your listings
- Copyright infringement or unauthorized use of images, photos, or text
- Violation of third-party intellectual property rights
- Misrepresentation of property ownership, features, location, or price
- Posting of prohibited, illegal, or inappropriate content
- Duplicate or spam listings
c. Transactions and Disputes:
- Any transaction or dispute between you and other users
- Disputes with property buyers, sellers, renters, or landlords
- Failure to honor agreements made through the platform
- Fraud, misrepresentation, or breach of contract in property transactions
d. Third-Party Rights Violations:
- Invasion of privacy or violation of publicity rights
- Defamation, libel, or slander
- Harassment, threats, or abusive behavior toward other users
- Unauthorized use of another person's identity or property
e. Legal and Regulatory Non-Compliance:
- Violations of applicable real estate laws and regulations
- Failure to obtain necessary permits or licenses for property transactions
- Tax evasion or failure to comply with tax obligations
- Violations of applicable consumer protection laws
f. Your Negligent or Wrongful Conduct:
- Any negligent, reckless, or intentional misconduct
- Harm caused to other users or third parties
- Property damage or personal injury resulting from your actions
Defense and Settlement:
You agree to cooperate fully with Mayadeen in the defense of any claim. Mayadeen reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree not to settle any such matter without Mayadeen's prior written consent.
Survival:
This indemnification obligation will survive the termination or expiration of these Terms of Service and your use of the App or Services.
11. Content Moderation and Notice & Review Mechanism
11.0 Mayadeen's Independent Moderation Authority
Mayadeen reserves the right to monitor all listings published on the platform independently and on its own initiative, without requiring a report from any user. Moderation actions under this Section 11 may be triggered either by Mayadeen's own review of listings or by reports submitted by users. All moderation actions, whether initiated by Mayadeen independently or in response to a user report, are governed by the procedures set out in this Section 11.
11.1 Listing Reporting Mechanism
We provide users with the ability to report listings they believe violate the Terms of Service. Reports can be submitted via:
- "Report Listing" button within the App
- Email: support@mayadeen.app
11.2 Acceptable Reporting Reasons
Reports must be based on one of the following reasons:
- False or misleading information: Incorrect listing description, location, or price
- Inappropriate images: Non-genuine listing photos or inappropriate content
- Fraudulent activity: Evidence of attempted fraud or scam
- Intellectual property violation: Use of copyrighted images or content without permission
- Illegal content: Promotion of illegal activities
- Duplicate listings: Same listing posted multiple times
- Spam: Harmful external links or non-real estate commercial advertisements
11.3 Review Procedures
Upon receiving a valid report, we follow these procedures:
- Receipt and Registration:
- Register the report in the system
- In-app confirmation displayed to the reporter upon submission
- Initial assessment of report validity
- Manual Review (within 72 hours):
- Examination of the reported listing by moderation team
- Review of evidence provided by reporter
- Verification of Terms of Service violation
- Temporary Suspension (if necessary):
- In serious cases (clear fraud, illegal content), the listing may be temporarily suspended during review
- Immediate notification to advertiser about suspension and report reasons
- Listing will NOT be permanently deleted until review is complete and final decision is made
- Advertiser Notification (within 48 hours of suspension):
- Send a detailed formal notice to the advertiser by email to the registered email address from moderation@mayadeen.app, explaining:
- Report reasons
- Potentially violated Terms of Service clauses
- The right to submit a defense response within 48 hours from the time the email notice is deemed received under Section 3.3
- To submit a defense response, the advertiser must reply to moderation@mayadeen.app before the stated deadline. The response must address the stated grounds for suspension and include at least one of: (a) an explanation of why the listing does not violate the cited clause; (b) evidence or proof that the identified issue has been corrected; or (c) factual information disputing the stated grounds. A blank reply, a general objection without supporting explanation or evidence, or a response received after the deadline will be treated as no response.
- Send a detailed formal notice to the advertiser by email to the registered email address from moderation@mayadeen.app, explaining:
- Final Decision:
- After reviewing all evidence and responses, a final decision is made to:
- Reject the report: Reactivate listing and compensate advertiser with suspension days
- Accept the report: Permanently remove listing with explanation of reasons
- After reviewing all evidence and responses, a final decision is made to:
11.3.bis Quick Administrative Action for Minor Violations
For minor, clear, and non-serious violations — including but not limited to spam content, duplicate listings, incorrect category placement, missing or inappropriate images, and listing format non-compliance — Mayadeen may temporarily unpublish a listing as a quick administrative action, without initiating the formal review process set out in Section 11.3. The following conditions apply to any such action:
- The advertiser receives an in-app notification specifying the precise reason for the unpublishment at the time the action is taken.
- The paid listing duration counter is automatically paused from the moment of the admin-initiated unpublishment and for its full duration.
- The advertiser may contact Mayadeen support within 7 days from the date the in-app notification is deemed received under Section 3.3 to contest the action.
- If the action is reversed following a support review, all paused days are automatically restored to the listing's paid duration in full.
- This is a reversible administrative action and does not constitute a finding of a Terms of Service violation. It does not trigger the formal Section 11.3 process unless Mayadeen separately determines that the underlying violation is serious in nature.
- Reinstatement standard: Reinstatement of an unpublished listing under this Section is conditional upon the advertiser demonstrating that the specific violation cited in the unpublishment notification has been corrected. Mayadeen will verify compliance with the cited listing requirements before reinstating the listing. Editing a listing without correcting the cited violation, or contacting support without providing evidence of correction, does not in itself entitle the advertiser to reinstatement.
- Non-responsive updates: Submitting an update during the 7-day fix window that does not address the stated violation does not constitute compliance and will not reset the fix window. Mayadeen will notify the advertiser if their update is found to be non-responsive to the stated violation, and the remaining fix window will continue to count down from the original unpublishment date.
- Expiry and escalation: If the advertiser does not demonstrate correction of the cited violation within the 7-day window, the listing will be permanently removed. Mayadeen may alternatively, at its discretion: (a) extend the unpublishment period pending compliance; or (b) initiate the formal review process under Section 11.3. The paid listing duration counter remains paused during any extension of unpublishment under this paragraph. Upon expiry of the 7-day window, the advertiser's ability to edit the listing is automatically suspended pending final removal or escalation by Mayadeen.
11.3.ter Escalation Upon Reinstatement
Where a listing has previously been unpublished under Section 11.3.bis and subsequently reinstated following compliance with the cited correction, any further violation identified on that same listing — whether of the same nature as the original or otherwise — will be treated as a matter for the formal review process under Section 11.3, without first applying the quick administrative action procedure in Section 11.3.bis. The following terms govern this escalation rule:
- Scope — listing-level: This escalation rule applies at the level of the individual listing. It does not automatically affect other listings published by the same advertiser, and it does not in itself constitute a finding against the advertiser's account.
- Procedural rights preserved: Escalation to Section 11.3 does not deprive the advertiser of procedural rights. The advertiser retains the full 72-hour defense window provided under Section 11.3(4), and all other protections of the formal review process apply.
- No mandatory time decay: The escalation rule does not expire automatically with the passage of time. Mayadeen retains full discretion to take prior Section 11.3.bis history into account regardless of how much time has elapsed since the prior action, subject to applicable data retention limits.
- Notification: Where Mayadeen invokes the formal review process under Section 11.3 by reason of this Section, the advertiser will be notified of that fact in the suspension notice issued under Section 11.3(3).
11.4 Removal Criteria
A listing will only be permanently removed if one of the following conditions is met:
- Existence of objective evidence of clear Terms of Service violation
- Advertiser confirms the violation or cannot provide convincing defense
- Repeated violations from the same account
- Court or government order for removal
Important: Reports without sufficient evidence or based solely on personal opinion will not result in listing removal.
11.5 Compensation for False Reports and Counter Pause Mechanism
To protect advertisers who paid listing fees, we apply the following compensation policy:
- If the report is rejected after review:
- Listing is immediately reactivated
- The paid listing duration counter is automatically paused from the moment any admin-initiated suspension or unpublishment takes effect, and automatically resumes upon reinstatement of the listing. The net effect of this pause/resume mechanism is that the number of suspended days is restored to the paid listing period (e.g., if a listing was suspended for 3 days then the report was rejected, 3 days are automatically restored to the listing duration)
- Apology notice sent to advertiser
- If false reports are repeated from the same user:
- Reporting capability may be restricted from their account
- Account may be suspended or permanently banned
11.6 Right to Appeal
If your listing is removed, you have the right to:
- Submit an appeal within 7 days from removal date
- Provide additional evidence or clarifications
- Request a second review from the moderation team
Appeals will be responded to within 5 business days. The decision after second review is final.
11.7 Refund Policy Upon Removal
If your listing is removed due to confirmed Terms of Service violation:
- You are NOT entitled to a refund of listing fees
- Publishing your listing signifies your agreement to and compliance with the Terms of Service
- Removal due to violation is a result of your non-compliance, not our failure to provide the service
Exception: If the removal decision was erroneous (proven through appeal), Mayadeen will issue a new free listing for the same remaining paid duration as compensation. Permanently removed listings cannot be restored.
Note: The appeal mechanism in Section 11.6 applies to moderation decisions only. Listing removal triggered by a store-granted refund is governed by Section 5.5 and is not subject to appeal under this Section.
11.8 Finality of Decisions
Decisions made after second review (appeal) are final and binding. No additional reviews will be conducted except in exceptional cases (new substantial evidence, clear procedural errors).
11.9 Cooperation with Authorities
In cases of criminal violations (fraud, scam, forgery, illegal content):
- We reserve the right to immediately remove content without prior notice
- Report illegal activities to competent authorities
- Provide data and evidence to judicial authorities upon request
12. Account Termination
We may suspend or terminate your account if:
- You violate these Terms
- You engage in fraudulent activity
- Your account remains inactive as described in Section 12.1 below
- Required by law
When we suspend or terminate your account, we will send a notification email to your registered email address.
12.1 Inactive Accounts
An account is considered inactive if it has not been accessed (logged into) for a continuous period of 24 months. Before deleting an inactive account, Mayadeen will send a warning notice to the registered email address at least 30 days before the planned deletion, giving the user the opportunity to log in and reactivate the account. If the user does not log in within that 30-day window, the account and all associated data — including all listings and images — will be permanently deleted. Any active paid listings at the time of deletion due to inactivity will be deleted without refund, as the service was available throughout the paid period.
You may delete your account at any time directly in the App settings. Deletion is immediate and self-service — no request to support is required. Account deletion is permanent and irreversible. Upon deletion, your registration data (email address, full name, phone number), all your listings, and all images attached to those listings are permanently deleted and cannot be recovered. Any unexpired paid listing fees are non-refundable upon voluntary account deletion. Certain records are retained after deletion as described in our Privacy Policy, Section 5.2, including content moderation reports you submitted, audit log entries, and consent records.
13. Changes to Terms
We may update these Terms from time to time by posting the updated version on this page. Your continued use of the App or Services after changes constitutes acceptance of the new Terms. It is your responsibility to review these Terms periodically.
14. Governing Law and Jurisdiction
14.1 Governing Law
These Terms of Use are subject to and shall be interpreted in accordance with the laws and regulations in force in the Syrian Arab Republic.
14.2 Jurisdiction
In the event of any dispute relating to the use of the application or the services it provides, the exclusive jurisdiction shall be with the courts of the city of Damascus.
14.3 Dispute Resolution and Limitation Period
Voluntary Dispute Resolution:
Before initiating any legal proceedings, we encourage users to attempt to resolve disputes through:
- Direct Communication: Contact us at support@mayadeen.app to discuss your concern
- Voluntary Mediation: If direct communication fails, either party may propose non-binding mediation through the Damascus Chamber of Commerce or another mutually agreed mediator
Either party may choose to skip these voluntary steps and proceed directly to court if they prefer.
Time Limit for Filing Claims (Statute of Limitations):
Any claim, dispute, or legal action arising from or relating to your use of the Mayadeen App or Services, these Terms of Service, or any transaction conducted through the platform must be filed in court within one (1) year from the date the cause of action arose.
When Does the One-Year Period Start?
- For listing issues: When you discovered (or reasonably should have discovered) the problem with your listing
- For payment disputes: When the payment transaction was completed
- For account suspension/termination: When the suspension or termination occurred
- For refund claims: When your refund request was denied
- For fraud or misrepresentation: When you discovered (or reasonably should have discovered) the fraud
Effect of Missing the Deadline:
If you do not file your claim in court within the one-year period, you permanently forfeit your right to pursue that claim. This time limit applies regardless of whether you were aware of your legal rights at the time.
No Extension or Waiver:
This one-year limitation period cannot be extended, paused, or waived except as required by mandatory applicable law. Attempting voluntary mediation or contacting customer support does NOT pause or extend this deadline.
15. Language
These Terms are provided in Arabic and English for your convenience. In case of any conflict or inconsistency between the Arabic and English versions, the Arabic version shall prevail and be the legally binding version.
16. General Provisions
16.1 Severability
If any provision of these Terms of Service is found by a court or other competent authority to be invalid, unlawful, or unenforceable, that provision shall be deemed severed from these Terms. The remainder of these Terms shall continue in full force and effect to the maximum extent permitted by law. If possible, the invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
16.2 Entire Agreement
These Terms of Service (as identified by the "Last Updated" date at the top of this document), together with our Privacy Policy (as currently in effect and linked from the App), constitute the entire agreement between you and Mayadeen regarding your use of the App or Services. These Terms supersede and replace any prior agreements, understandings, or representations, whether written or oral, relating to the subject matter herein.
16.3 No Waiver
Mayadeen's failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Mayadeen. No waiver of any breach or default shall constitute a waiver of any subsequent breach or default.
16.4 Assignment and Transfer
Your Rights: You may not assign, transfer, or delegate these Terms or your rights and obligations hereunder, in whole or in part, without Mayadeen's prior written consent. Any attempted assignment or transfer in violation of this provision shall be null and void.
Mayadeen's Rights: Mayadeen may freely assign, transfer, or delegate these Terms and its rights and obligations hereunder, in whole or in part, without restriction. This includes assignments in connection with a merger, acquisition, corporate reorganization, sale of assets, or by operation of law.
16.5 No Third-Party Beneficiaries
These Terms are for the benefit of, and will be enforceable by, only you and Mayadeen. These Terms do not confer any third-party beneficiary rights upon any other person or entity.
16.6 Section Headings
The section and subsection headings in these Terms are provided for convenience only and shall not affect the interpretation or construction of these Terms.
16.7 Force Majeure
Mayadeen shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay is due to circumstances beyond its reasonable control, including but not limited to:
- Natural disasters: Earthquakes, floods, fires, storms, or other acts of nature
- War or civil unrest: War, terrorism, riots, civil disorder, or armed conflict
- Government actions: Government orders, laws, regulations, embargoes, or sanctions
- Infrastructure failures: Power outages, internet disruptions, or telecommunications failures not caused by Mayadeen
- Pandemics or epidemics: Public health emergencies, quarantines, or travel restrictions
- Strikes or labor disputes: Strikes, lockouts, or labor shortages affecting third-party service providers
- Technical failures: Failures of third-party hosting providers, payment processors, or other critical service providers
During any period of force majeure, Mayadeen's obligations shall be suspended for the duration of the event. Mayadeen will use reasonable efforts to minimize the impact and resume normal operations as soon as practicable.
16.8 Notice Requirements
Notices to Users: Mayadeen provides notices to you via in-app notifications posted within the Mayadeen application, including updates to these Terms or Privacy Policy. Such in-app notifications are deemed received 24 hours after posting, in accordance with Section 3.3, whether or not the user has opened or viewed them.
Listing-Level Moderation Actions: All listing-level moderation actions — including but not limited to listing suspension, listing unpublishment, apology notices issued to advertisers under Section 11.5, and final decisions under Section 11.3(5) — are communicated to the advertiser exclusively via in-app notification, governed by the deemed-receipt rule in Section 3.3.
Permanent Listing Deletion Following Flow 2 Deadline Expiry: Where a listing is permanently deleted following expiry of the response deadline under Section 11.3(4), notice of that deletion is provided exclusively via in-app notification. No separate email notice will be issued at the point of deletion. The suspension notice email sent under Section 11.3(4) constitutes advance notice that permanent deletion may follow non-response, and the advertiser is deemed to have been warned of this consequence from the moment that email is received under Section 3.3. The timing of deletion after deadline expiry is at Mayadeen's administrative discretion and may occur at any point thereafter; no further advance notice of the specific deletion date or time will be provided.
Account-Level Actions: For account suspension or termination under Section 12 only, notice will also be provided by email to your registered email address. Such email notices are deemed received 24 hours after sending, in accordance with Section 3.3. You are responsible for keeping your registered email address valid and up to date.
Detailed Moderation Notice under Section 11.3(4): The detailed notice that opens the 48-hour response window for a suspended listing is sent by email from moderation@mayadeen.app to the registered email address. The 48-hour response window begins when that email notice is deemed received under Section 3.3 (i.e. 24 hours after sending). Defense responses must be submitted by email to moderation@mayadeen.app before the deadline stated in the notice. Responses received after the deadline will not be considered. The deadline timestamp stated in the notice email is the operative deadline and constitutes the final expression of that calculation. No claim of delayed actual receipt or delayed reading shall operate to extend the deadline beyond the stated timestamp.

16.9 Electronic Agreement and Acceptance
By clicking "I Agree," "Sign Up," "Continue," or similar buttons, or by accessing or using the App or Services, you acknowledge that:
- You have read and understood these Terms of Service in their entirety
- You agree to be bound by these Terms and our Privacy Policy
- Your electronic acceptance constitutes a legally binding agreement equivalent to a handwritten signature under applicable law
- You have the legal capacity to enter into this agreement
Record Keeping: Mayadeen maintains electronic records of user acceptance of these Terms, including timestamps and IP addresses, which may be used as evidence of your agreement in any legal proceedings.
